Welcome to Via Mercatus ("Website"). These Terms and Conditions ("Terms") govern your access to and use of our Website and newsletter services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.

- Prohibited Conduct: You agree not to:
- Use the Services to send, post, or distribute any unlawful, defamatory, or infringing content.
- Attempt to interfere with the Website’s functionality, including uploading viruses or malicious code.
- Collect or harvest personal information from other users without their consent.
- Violate any applicable laws or regulations.

3. Intellectual Property
All content on the Website, including text, graphics, logos, and newsletters, is the property of Via Mercatus or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You may not use, copy, or distribute any content without express permission, except for personal, non-commercial use as permitted by law.
4. Disclaimers
The information provided by Via Mercatus ("Website") and its newsletter services ("Services") is for general informational purposes only. All information is provided in good faith; however, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Website.
- Via Mercatus is not registered with the U.S. Securities and Exchange Commission (or with the securities regulatory authority or body of any state or any other jurisdiction) as an investment adviser, broker-dealer, or in any other capacity, and does not provide investment advice or recommendations. The Website and its content are provided for the sole purpose of enabling you to conduct investment research. Other uses of the Website and its content are expressly prohibited.
- Authors may or may not have positions in the securities or related securities mentioned in posts.
- Data is provided on a best-effort basis, and we make no guarantee of its accuracy.
- Trade and invest at your own risk. Leveraged ETF trading involves substantial risk and is not suitable for every investor. An investor could potentially lose all of their initial investment. Risk capital is money that can be lost without jeopardizing one’s financial security or lifestyle. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results.
- Hypothetical performance results have many inherent limitations. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program.
- One limitation of hypothetical performance results is that they are generally prepared with the benefit of hindsight.
- Hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading.
5. Limitation of Liability
To the fullest extent permitted by law, Via Mercatus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from your use of the Services, including but not limited to any errors or omissions in the content, or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Services.
In no event shall the aggregate liability of Via Mercatus for all claims arising out of or relating to these Terms or the Services exceed the amount you paid Via Mercatus, if any, for the subscription during the twelve (12) months preceding the claim.
Via Mercatus operates under the publishers exemption of the Investment Advisers Act of 1940 and does not provide personalized investment advice. The information provided is for general research purposes only and is not intended as a recommendation or solicitation to buy or sell any securities. You acknowledge that any reliance on material contained on the Website is at your own risk.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
6. Third-Party Links
Our Website or newsletters may contain links to third-party websites. We are not responsible for the content, privacy policies, or practices of these third-party sites. You access them at your own risk.
7. Changes to These Terms
We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
8. Governing Law
These Terms are governed by the laws of California, USA. Any disputes arising from these Terms shall be resolved in the courts of California, USA.
9. Refund Policy
We offer refunds on subscriptions in accordance with the following policy:
- Monthly Subscriptions: If you cancel your monthly subscription, you will receive a full refund for the current month if the cancellation is made within the first 28 days of the billing cycle. After 28 days, no refund will be provided for the current month, and the cancellation will take effect at the end of the billing period.
